I’m not positive, but I belive its a reference to the old Scottish tradition of “kidnapping” a bride when the groom couldnt pay the bride price. Kidnapped being in parentheses because this was generally with the brides agreement, but was also occasionally done to force a marrage that was non concentual. I do know that the possition of “Best Man” stems from this tradition, because when you went after the bride you took along the best man to have in a fight that you could in case it didnt go well.
I can’t tell you where it comes from, but “getting off Scot free” means that you escaped all the consequences of your (implied to be bad) actions.
